Main Aims/Objectives

The specific function of the master’s, namely, as a future analyst in the research area of organized crime, this course unit aims to transmit advanced knowledge about how to address the procedural actors, in terms of professional strategies, in reason of their pedagogic and scientific formation. The most appropriate way to carry out the steps, includes respect of the functions that the lawyer plays in any procedural steps.

Specific Aims/Objectives

Hence, the formation is placed, primarily, in terms of the need, not only of «know – how», but also of judicious exercises that help to optimize the legal performances, namely, in the Center for Judicial Studies, in the Judicial Police, in the Order of Lawyersr, etc.

Skills to be acquired

From the presentation of the matters related to the disciplines such as the Law, the Criminal Investigation, the Criminology and the Scientific Police, will be transmit knowledge able to allow the student make the analysis of the criminal process and about their intervinients, as well as the formulation about the procedures in terms of the study of organized crime in order to understand what happens, what they do, who can do what and when, in terms of national and international institutes.

According to the most appropriate pedagogic methods to the matters in cause: expositive, demonstrative (with movies), interrogative and active.

Programme

The courts, as weel as the other formal or informal organs of social control, and the anonymous general public, have been demanding, increasingly, a better and higher contribution of lawyers as binding elements of criminal and forense investigation. The key to avoiding the technical slide in seat of presentation of proofs in the investigation of organized criminality is the higher than that wich exists under the common crime investigation degree.
Here doesn’t exists fingerprints, blood, hair, sperm, among other vestiges, because the «place of the crime» is volatile and distant. Accordingly, the lawyer should be trained and sensitized in terms of technical and scientific developments in this area, wich sometimes results in understanding about the intersection and about the correspondence between the investigation of the common and organized criminality.
To achieve this aim, we will cover, among others, the following materials:
Organized crime versus Common crime. Juridical, criminal and forense aspects aspart of homeland security. The proof: quality, type and means of obtaining evidence in organized crime. Origin and evolution of organized crime.
Criteria for defining organized crime. Types of organized crime. Type - structures more representative. International organized crime. Areas of criminal activities with international character. Laic and religious terrorism. National organized crime. Banditry. Trafficking of drugs. Trafficking and viciation of vehicles. Economic crimes and others. Smuggling. Illegal gambling. Corruption. Treatment and analysis of criminal intelligence on organized crime. Solutions to address these specific problems.
Negotiation

Evaluation Type

1.Continuous assessment: applied in function of the student «learn to be» and to the «know how», through the monitoring their progresso (integration of ideas, contents and concepts; appropriateness of the conclusions and personal investment and creativity).
2.Written periodic assessment in two stages: (60%, by superior decision).
3.Final written test/ assessment: (40%, by superior decision).
