Main Aims/Objectives

To enable students to critically analyze legislation and case law, as well as the relevant doctrine in each case: to take critical, dialogical and argumentative positions.

Specific Aims/Objectives

Acquire a transversal vision of complex problems of current relevance under discussion in jurisprudence, as well as in the national and international academic community, through the study of the best university production in law and the standards of legal thought and argumentation.

Skills to be acquired

1) Development of critical thinking;
2) Developing the capacity for critical analysis of the subjects covered and, in particular, with regard to national legislative options within the broader framework of the European Union;
3) Acquire research skills and methods in the field of legal science;
4) Acquire the skills to communicate with the scientific community and society in general on a specific area of law, particularly in the legal and business sciences.

Teaching Procedures

Presentation, exploration and discussion of topics based on recommended readings.
Seminars with oral presentations and autonomous written work.

Programme

1) Information on how the course unit works.
2) Explanation and methods of bibliographical research.
3) Rules for preparing written work.
4) Seminars on critical analysis of legislation, case law and doctrine.
5) Oral presentation of the research work, based on Private Law themes, focusing on the areas of Commercial Law and Consumer Law, chosen on the basis of their complexity, namely:
a) Commercial Contracts;
b) Commercial Companies;
c) Insolvency Law;
d) Credit Securities;
e) Consumer Contracts;
f) Electronic contracting;
g) Labor Law;
h) Other relevant topics in the field of legal and business sciences.

Evaluation Type

The inductive and interdisciplinary method will be used: presentation of complex or topical issues which students will debate, with reference to legislation, doctrine and case law. The work, carried out in a seminar context, will be subject to written and oral assessment with presentation in class.

Legislation, Internet for research and access to documentation. Scientific articles, periodicals and bibliography.
