Main Aims/Objectives

it is intended that the student is able to understand the Portuguese criminal procedure, and the purposes of due process (fair trial) imposed by the Rule of Law.

Specific Aims/Objectives

Since the purpose is to allow the student to understand the criminal justice process, it is necessary to determine the applicable constitutional principles, to distinguish between the main actors and the secondary participants, and to identify the stages of the criminal procedure.

Skills to be acquired

The aim is to provide skills for reflection and critical analysis of law enforcement as an object of study of criminology.

Teaching Procedures

The exposition of the matter followed by analysis and discussion based on practical examples is the method considered appropriate both for the apprehension of theoretical knowledge, and for the subsequent critical reflection.

1. Criminal procedural law in light of the contemporary understanding of the Global Science of Criminal Law.
2. The purposes of due process (fair trial) imposed by the Rule of Law. Constitutional provisions affecting law enforcement conduct.
3. Rules of criminal procedural law enforcement..
4. Procedural actors and secondary participants.
5. The common criminal proceedings.
5.1. Investigation, prosecution. General principles.
5.2. The pre-trial
5.3. Admissibility of law enforcement conduct, in particular, exclusionary rules relating to evidence, police measures, arrest, detention and other coercive measures.
5.4. The trial
6. Challenge of decisions. Appeal
