Main Aims/Objectives
It is intended to promote an understanding of restorative justice as a model of responding to crime that is different from criminal justice. The student should be able to answer questions about the why, for what, and the how of restorative justice. They should also understand penal mediation as a restorative practice and know the legal basis that, in Portugal, supports the possibility of adopting such practices in different moments of the process of response to crime.
Specific Aims/Objectives
All the programmatic content aims at the acquisition of knowledge that allows the student to understand the emergence of Restorative Justice as an alternative to punishment and to critically evaluate criminal mediation as an instrument of that new criminal policy.
Skills to be acquired
Students should gain theoretical knowledge about the meaning and purpose of restorative practices and the ability to critically consider this criminal policy proposal as opposed to the response to crime provided by criminal law.
Teaching Procedures
In the lecture classes, we will start with an explanation of the topic, followed by a discussion and eventually a presentation of student work.
Programme
1. Restorative Justice - Why? The criminological reasons for its emergence.
2. Restorative Justice - What for? The aims of Restorative Justice - analysis of its specificities in comparison with the aims of the penalties.
3. Restorative Justice - How? The restorative practices (conferences, restorative circles, and mediation) and the predominance, in Europe, of penal mediation.
4. The restorative practices admitted by the Portuguese legislator: the penal mediation as a diversion mechanism and the post-sentence mediation.
