Main Aims/Objectives
It is intended that the student acquires knowledge about European Law, with special focus on the sanctioning aspect that increasingly presents.
Specific Aims/Objectives
At the end of the course unit the student is able to understand the principles governing the European sanctioning law, its interrelations with the national legal orders, and also a specific knowledge in the field of European competition law.
Skills to be acquired
Enable students with the skills to understand the dogmatic and essential legal institutes relating to European law, as well as fundamental rights as general principles of European sanctioning law, allowing students to possess a scientific knowledge about this branch of law and themes.
Teaching Procedures
Classes are both theoretical and practical, explaining the subjectmatter together with the analysis and discussion of relevant practical cases.
Programme
1- Introductory considerations on European law: the European legal order as an autonomous and sui generis legal order
2 - The structuring principles of European law
3 - The substantive framework of European sanctions law and the "negative" and "positive" effects of the interrelation of the European legal order with the legal orders of the Member States: the ius non-puniendi and the principles of equivalence and effectiveness of european law
4- The legal framework of European sanctioning law
5- The jurisprudential construction of a "fair process of law" in European sanctioning law
6 - The paradigmatic example of European sanctioning law: competition law
Evaluation Type
Students will be assessed as follows:
— Oral participation (including paper presentation): 15 %
— Written paper: 70 %
— Final Exam: 15%
